Electronically Stored Evidence (ESI) presented to the Court has become highly technical and therefore difficult to understand in many cases. Recently there has been a spate of cases where evidence has been misrepresented to the court and during Forensic Expert testimony the fact of the evidence was discovered resulting in sometimes a dramatic response by the Court. What happened and why?
